Terms of Service

1. Agreement

By installing or using Drapify ("the Service"), you ("Merchant") agree to these Terms of Service. If you do not agree, do not install or use the Service.

2. The Service

Drapify provides AI-powered virtual try-on, shopping assistant, and related features as a Shopify embedded application. Features and pricing are described in the Shopify App Store listing and the Drapify admin dashboard.

3. Eligibility

You must have an active Shopify store and the legal capacity to enter into this agreement on behalf of your business.

4. Subscription, Billing, and Trial

• Billing is handled by Shopify Managed Billing. You authorize Shopify to charge your account per your selected plan.
• Token top-ups are one-time charges and are non-refundable once consumed.
• Free trials are offered once per store. Returning installs do not receive a new trial.
• Plan changes take effect according to Shopify's standard proration rules.

5. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your Shopify store during the subscription period.

6. Your Responsibilities

You agree to:

• Use the Service in compliance with all applicable laws
• Obtain any required consents from your customers for use of their data with the Service
• Maintain accurate account and contact information
• Comply with our Acceptable Use Policy
• Maintain a privacy policy on your storefront that discloses your use of virtual try-on and AI assistant features

7. Intellectual Property

The Service, including its software, design, AI models, and content, is owned by Drapify and protected by intellectual property laws. You retain all rights to your store data, products, and customer data.

8. Generated Content

AI-generated images and assistant responses are produced based on inputs you and your shoppers provide. You are responsible for reviewing generated content before publishing or relying on it commercially.

9. Acceptable Use

You may not use the Service to process content that is illegal, infringing, sexually explicit, hateful, or otherwise prohibited by our Acceptable Use Policy.

10. Privacy and Data Protection

Our processing of personal data is governed by our Privacy Policy and, where applicable, our Data Processing Agreement (DPA).

11. Service Availability

We strive for high availability but do not guarantee uninterrupted access. Planned maintenance, third-party outages, and force majeure events may affect availability.

12. Suspension and Termination

We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that creates legal, security, or reputational risk. You may uninstall the Service at any time from your Shopify admin.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, Drapify's total liability arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

15. Indemnification

You agree to indemnify and hold Drapify harmless from claims arising out of your use of the Service in violation of these Terms or applicable law.

16. Governing Law and Disputes

These Terms are governed by the laws of Lahore, Pakistan, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of Lahore, Pakistan.

17. Changes to These Terms

We may update these Terms. Material changes will be notified via the Drapify admin dashboard. Continued use after changes take effect constitutes acceptance.
